The freedom of speech... It's in the Bill of Rights. Just because you don't like doesn't change the fact that it's protected, as it should be, by the constitution. Some libs 20 years ago were obviously able to comprehend the constitution for what it was meant & not go by personal feelings on the subject. Oh well, it's just a difference of opinion now. Nothing left to debate I suppose.
Its a waste of time because legislative sessions are of limited time. Laws passed should be relevent. If a flag burning amendement is ever passed then this law would make sense. Until then then we have court precedent which is clear. Flag burning is protected speech.
I would have loved to seen some long haired hippy or puddle jumper burn our flag in front of one of the framers of our Constitutio. He or she would have been beaten, then shot, and probably hung by the neck just for good measure.
Maybe. But they put the amendment in the constitution for a reason, and I think they would have stuck to that.
You mean the framers of our constitution who destroyed symbols of the British government during the revoloution. I would hope the forefathers were less hypocrytical.
Several states, inlcuding Louisiana, are passing abortion legislation, even though it's been ruled legal by the Supreme Court. Is that also a waste of time?
Yes. There is already a test case on its way up the chain that might short-circuit this legislation. It makes sense to wait. This is just a political stunt to impress a certain segment of voters.
No. They are hoping with the recent conservative nominations that Roe v. Wade will soon be overturned.
No, and its an apples and oranges situation. The abortion case may set up a Supreme Court challenge. The more conservative court could overturn Roe V Wade. The chances of the court overruling existing precedent on flag burning is much less likely. Additionally the Flag burning law only goes into place if a flag burning amendment is rattified. The flag buring law isnt designed to challange existing precedent, just to get the legislators name in the paper.
Why wouldn't a more conservative court reconsider the flag burning issue like you think they'll do for abortion? Not the Louisiana legislation. They are setting it up just like the flag burning legislation. It'll only go in effect if Roe v Wade is overturned, not to challenge existing law.
