good thing you live in Texas my friend. Just make sure that you kill that "person" in your house, do not reload your weapon, and say you thought that "person" meant you physical harm........per Texas law you should be safe for protecting your home, and you would have to get a really wack grand jury to convict you. reload your clip and you have intent.....that would not be good. same if said "person is out of your house in your yard.......at that time I would drag that "person" back into your home.
A couple of years ago, a guy in Houma unloaded 14 shots from 2 guns in a some guy when a drug deal went bad. He then attempted to hide the body and destroy the car the shooting took place in. He's scheduled to get out next year. He pled self defense. 14 bullets from 2 guns!!!!
Grand juries indict, not convict. And no, no jury in their right mind convicts a guy shooting an intruder.
I read in the paper that Texas is one of the few, if not only, states where it is legal to use deadly force "to protect your life OR PROPERTY". So if someone has jumped in your truck to steal it, is starting it up, and you shoot and kill them, its legal. It will go to the grand jury, but probably not to trial. I've seen some cases like this in the paper. In one, a "repo man" was taking a truck at 3 AM, the owner shot and killed him, and the shooter got off because he had no way of knowing the repo man was not a thief. He was protecting his property.
As long as you are not laying in wait of an intruder then its all good. And Texas still has the law on the books that you can LEGALLY hang in public anyone caught stealing cattle. No trial, no cops, no nothing but a short peice of rope and a steady branch
Does the cow still have to be living or would that law work if I caught my neighbor stealing an extra burger off my grill?
