Yes, you're in the neighborhood. Technically it's not a Breach as much as it is considered Constructive Termination. When an Employer creates an environment that prevents an Employee from meeting their specified performance, the Employer is typically found at fault and frequently negotiates a "Settlement and Release Agreement". Basically, the AU Administration created such an environment and will likely be forced to meet the payoff - for CTT and many of his staff members. It's why I carry a healthy level of D & O Insurance.

If Auburn does not fire Bobby Lowder (which they won't) the problem will not be resolved.
