Yep, Agreed, hearsay can now be used in a court of law. This is my last post on this thread, I'm fed up with people on here that have no concerns for the disputes in this case. The only thing I have to say is I hope their is an investigation in this case from beginning to end including everything to do with Judge Greer and everything thats happened including the role of the judicial system. In this case you have 1 judge making all the decisions and the other courts being lazy and just siding with this 1 judge. No one should have a dispute with a complete investigation to make sure everything was done correctly but I'm sure some of you. Probably the ones that I have gone back and forth the most. Better watch out for the right to lifers and an election revolution the next 10 years or so. Bye
Look, I'm coming in on the backside of this only having seen brief snippets of TV coverage. I asked for cold hard facts about the case. I understand that there has been a dispute, but I also understand that it's been 15 years since she suffered brain damage. Intellectually I believe that she is in a vegetative state as according to what few doctors reports I've seen. How many doctors have examined her and reported vegetative vs those that haven't? Just tell me that. Someone? Anyone? Bueller?
Her husband reported on The Today show that about 150 doctors have examined Terry Schiavo in the last 15 years and all have pronounced her as vegetative. An earlier post here cited that 33 doctors have recently stated that she may not be vegetative, but they have only seen a single video shot by her parents. The latest physician, cooperating with the Florida governor Jeb Bush, stated that he believed she was misdiagnosed. However he only stood by her bed for 15 minutes and never properly examined her. I can't vouch for these numbers but it's what I've seen reported.

You keep saying hearsay, but you obviously don't understand what hearsay is and how it is applied in a legal proceeding. Please, please do a little research on this issue. Let me ask you one final question since you are tired of discussing it. If new doctors were brought in and they all concluded Terri was in a vegetative state and the parents still wanted to keep her alive, would you be opposed to removing the feeding tube? It's an important question b/c I don't believe the medical condition, or even who has the right to make this decision, are the real issues for some of the people opposing this case. It seems to me that right-to-lifers simply don't want to see the feeding tube removed under any circumstance. I'm curious to know your position on this question. Anyone else feel free to chime in on this question as well....
Without question, get a living will. This case has proven that a verbal conversation may not be good enough. Living wills are pretty simple and straight forward, as well as free. It doesn't require an attorney, nor does it have to be notarized. It only requires two witnesses. Most of them are only a page or two long, and you can find many samples on the net. Red's links are a good place to start. Of course, consulting with an attorney may not be a bad thing to do if you are unsure.
I don't know about that. Schaivo seems to have the courts convinced that his wife wanted this based on a "verbal conversation".
God, I don't really want to do this but what the heck. 1) Hearsay__Law. Evidence based on the reports of others rather than the personal knowledge of a witness and therefore generally not admissible as testimony. I have a problem with the court system, generally not admissible? I don't think it should be used in this case or in any case, facts only! Your scenario isn't the case though... 2) That isn't the case, Their are disputes on both sides. If I could fix things the tube would be re-inserted and a full fledge investigation would happen from day 1. I think the courts and their actions should be reviewed and under investigation as well as "all" involved in this case. Whoever is right prevails just to make damn sure the right decision is made. 3) You don't believe the medical issue is the reason? For me its the only issue, I watched the videos of Terri on the internet. I watched the videos of the attorneys on both sides along with where they stand. I've listened to doctors and nurses on both sides. Their is a dispute and only 1 judge making all the "tough" decisions from what I can tell. She shouldn't die until the dispute is resolved, if Michael turns out correct then so be it. 4) I don't have any trouble with anyone who has a written will. What I do have a problem with is an ex-husband or one who has another wife with kids, seems like a conflict of interest. 5) I just want to make sure our justice system gets it right! This is to crucial to get it wrong. I'm with the president, we should always error on the side of life. From what I've seen I have doubts that Terri is in a persistant vegetative state, this is why I've posted here like I have. My baby girl has down syndrome, My uncle is a shell of his former self but can communicate some, Alzheimers patients, etc. There are plenty of people with less quality of life than you and me. I've been around some autistic people and down syndrome children, they love life just like we do. Not sure if you said anything about quality of life, alot of good intentions can go bad, when the barriers start falling things go to far. Haven't we seen that enough with political correctness and little boys and girls being suspended for things such as sexual harrassment?
