money doesn't have to be exchanged,.. if the foreign agent spends money that is a violation,.. pays for the meeting room, pays for the internet to send the email, buys gas to drive to the meeting etc. Really though, who cares about the foreign agent,.. the Feds will be hard pressed to prosecute foreigners.
