Why because torture is not an effective way of getting information, and it is more effective of getting someone to admit to doing something they didnt do or had no intention of doing. Your logic allows for people to be treated without rights, this sets the president for innocent people to be tortured to have their dna taken if a cop sees fit. So if a judge makes it legal for police officers to take everyone guns is it legal. NO the government cant give or take rights their are rights that we have as human beings given to us by God that no man can take or give. So no the judge just gave someone power to do something neither of them have the power to do.
