It's a big deal because it's restricting a right that hasn't been abused by the majority of gun owners and enthusiasts. I'm not a fan of that type of punishment or approach. This analogy needs to die. It was never binding law, and the underlying case, U.S. v. Schenck, was overturned over 45 years ago. It's important to note U.S. v. Schenck had nothing to do with fires or theaters or false statements. Instead, the Court was deciding whether Charles Schenck, the Secretary of the Socialist Party of America, could be convicted under the Espionage Act for writing and distributing a pamphlet that expressed his opposition to the draft during World War I. The fire analogy was O. Wendell Holmes comment when delivering the court's decision. It isn't and yet that wasn't Steven's point, nor mine. It is naive IMO to think that the people who want "simple restrictions" today aren't planning to continue until they go after a full repeal. If not, then why all the hatred toward the NRA? And yet laws will do nothing to prevent that type of kid from getting their hands on a street sweeper. These alleged common sense laws will not prevent school shootings. As with most serious issues, people are attacking the problem at the END of the process rather than putting in time and effort to solve the 'why' the issue occurs in the first place. The treatment is more profitable than the cure. Until these bratty, obnoxious teenagers go after big pharma and doctors who over-prescribe, then they are a waste of time and oxygen. I also think it's fucking stupid that a state would make marijuana legal with absolutely NO way to detect or determine whether a driver is impaired by marijuana. Just want to point it out.....as you say, heroin is illegal. Marijuana is illegal. Have been for decades. Yet they can still be found everywhere! Acknowledging that, you have to wonder...why does anyone think making a gun illegal will make it disappear?
