    Different argument. People who beat up blacks for being black were committing assault, and it was a failure of law enforcement if they weren't getting arrested for it. Point is, there was already a law to cover it without calling upon a constitutional decision. That's not what we're talking about. We're talking about whether a person has "the right to refuse service" (I'll bet you've seen a sign like that in a store). If a baker, just as an example, wants to decline a gay couple's business just because they're gay, have they been denied a fundamental right? Can they not drive to the bakery in the next block and seek his services? And the beautiful thing is, in this day and age, the first baker can be brought to task without it becoming a legal question. The gay couple will soon spread the word, there will be a facebook page denouncing the baker, they can gather support to peacefully and lawfully picket the baker, and then it will be incumbent on the baker whether he wants to accept the hit his business will take, or get over his narrow-minded views and accept a gay clientel.

    And getting back to intolerance.....just which side is doing that?

    "A northern Indiana pizza shop that came under fire after its owners said their religious beliefs wouldn't allow them to cater a gay wedding is closed indefinitely, and its operators say they've gone into hiding.

    Memories Pizza in Walkerton faced criticism this week after co-owner Crystal O'Connor expressed support for a new Indiana religious objections law. The Facebook and Yelp pages for the restaurant about 20 miles southwest of South Bend were bombarded with negative reviews.

    A coach of a high school golf program was suspended after a Twitter post that mentioned going to Walkerton and burning down the restaurant.

    WNDU-TV reports that O'Connor and her family are considering leaving town."

    Intolerance runs amuck, left, right and middle. There is a ton of gray area here and English Common Law provides for judges to make decisions on these things, case by case, hearing all extenuating circumstances, and guided by precedence. It has long proven to be a fair, largely consistent, yet flexible arrangement. The modern tendency to French-style Civil Law where there is a plethora of legislative laws spelling everything out in black and white is poorly equipped to handle gray areas, much less issues that are in technicolor.

    Say that a gay couple orders a cake for their wedding that is shaped like a giant penis. A baker refuses to make the cake. Is he discriminating against a gay couple, causing them emotional distress, and violating their federal civil rights? Or is he adhering to federal guidelines regarding unwanted sexual objects in the workplace and protecting the civil rights of his female employees? Or is that just a cover to hide the baker's religious objections to gay marriage?

    It is futile to make a law that covers all circumstances, so we make it broad and let the judges sort out the details.

    They also received over $445,000 dollars in right-wing donations in one day. They are probably in Cancun, laughing their asses off.

    I'm sure a big chunk is from the "right-wing". However, libertarians don't like this kind of thing either. I might also add that pizza lovers everywhere are pissed off, too. ;)

    That amount will slow down some and when you consider the amount of money it takes to run a restaurant, just to eek out a minimal profit, shutting down for even a week will not allow for a Cancun romp. Employees, insurance, rent, supplies that were already paid for, still have to be paid.

    By "eke out a minimal proft" I don't think you are referring to a local man who owns about 40% of 4 restaurants in the Baton Rouge area. I recently found out that his share of the profit is around $3 million a year.

    they were beaten because of civil disobedience of denial of service. the civil rights movement wasn't about assault, it was about denial of service--separate but equal.

    i don't think this gay denial of service is illegal, but it should be. and it will be soon. even the fundies see the writing on the wall (ha, biblical reference)--this is just grasping for straws. soon gays will be a protected class across the country.
