I have no problem with spelling out the penalties for abuse of this or any law.

Debate is a blood sport, amigo.

Actually it has been used as a model for many subsequent constitutions around the world.

The Constitution does not address profiling at all. I think I've made a case why the Arizona law is not profiling.

why cant we just upgrade them so they are harder to counterfeit like this id thing you are talking about?

i was about to say that maybe the government should offer a voluntary federal ID program but then i realized we already have them and they are called passports.

i didnt mean to say i oppose profiling. my question is how do we know who is not law abiding? illegals dont outwardly appear to be comitting any crime, they just look like any other dirty mexican. so how can we justify asking them for id?

I didnt think it was that good of a case:D, its still profiling to me because its so subjective and broad. In the words of Martin, just because I look like a dirty Mexican doesnt mean I am one.

I just dont see how you can be for this and be against legal memos written for torture. I dont see the difference. If you are going to profile, dont make a law basically spelling that out in so many words.

and looking like one, whether you are one or not, isnt reason enough to get stopped. but if you are speeding, or anything else to break the law, better have your papers handy.

hell, i get stopped all the time.

If Im not doing anything illegal, whos to say supercop wont just stop me and ask for my papers because I look like I might be illegal. Is that legal? I dont have a problem with the purpose but the method here is totally phucked.

And if you stop throwing O'Douls beer cans out of your car, you wouldnt get stopped all the time.

still not clear on why the driver's license doesnt work, except for that it is easy to forge, which seems like a separate problem that should be solved.

and i never get stopped by the cops for anything, i could be illegal and i would be going on like 10 years since i even spoke to a cop.

also, waiting for dirty mexicans to give us reasons to detain them seems kinda stupid, and also a solution to a problem that i dont believe really exists.

if my understanding is correct, it is not legal. and it it is not legal, i dont see how it could hold up to a court challenge.

and before you say low income etc, the hispanic groups that hate this law will be more than ready to represent the first one stopped that hasnt done anything to provide just cause.

i didnt say you were gonna be harrassed, or that if you were its ok. if its illegal to do so and if it happens, its gonna get challenged in court. and, i would think, that a court challenge or two, would make over-zealous cops think more than twice about stopping someone without just cause, to ask for papers. would you be willing to be taken to court or lose your job if you were a cop? i wouldnt. im not saying its not gonna happen, because there are rogue cops out there. (even i've been frisked for no reason.) but, imo, its not gonna be an every day occurance.
