Prohibition was the mistake of making a law prohibiting something that the citizens were very divided about. Constitutional amendments need to be about things that we are all basically in agreement about. Like alcohol, cheese fries and twinkies don't require everyone around them to eat some of it whether they like it or not. This is the key issue with tobacco, as far as I'm concerned. Infringement on others. The health issue cannot be completely ignored however, it costs this country a fortune and many families are destroyed by cancer deaths. We cannot really keep people from killing themselves, they will find a way. If they want to do it with cigarettes, all we can do discourage the practice by making it expensive for them. Tax the hell out of the cigarettes and use all of the money to defray cancers cost to the nation. We can also make it a practice shunned in public places. Many families ban smokers to the patio already. All cigarette advertising could also be banned. People who sell addictive substances, really don't need to advertise.
