I was being a bit facetious, but there have been instances where the govt decided there was more harm in bringing out the disclosure in court than the disclosure itself. But, those with that access would never give her a thought, she would be found guilty before they even left the jury box.
I think they didn't because of the SAP data they found. I am not sure how you would handle that given the sensitivity of that data. I dont think they want that information released at all. IN other words, it would most likely harm national security to bring it any further. So he just called her an idiot before the US public instead and everyone jumped for joy.
No, no it is not. If it is classified by the issuing agency (confidential, secret or top secret ) then it is classified. Removing a marker, or failure to apply one does not change the status of the information and it is also illegal for the common folk.
