1. trump does use that defense. he says he had a standing order for declassification. he had that power as president, unlike biden and hillary when they had secrets.
2. these cases are not about justice but politics. like the stormy daniels case where the legal justification for the case is absurd grandstanding, or the alleged E jean carrol rape where they dont even give him a chance for an alibi by knowing what year it happened.

If this were true there would be a record of his declassification. The President has wide authority to declassify while in office but there is also a process for communicating that declassification to the rest of government. This is not disputed.

This is absurd...even for you. These cases are all about justice. Let me help you with how our legal system works....it requires that you have evidence to support your allegations. If you don't have evidence, like anyone of Trump's sixty something court cases alleging election fraud, your case gets thrown out of court. It's very simple. Jack Smith has gathered the evidence, presented it to the grand jury, gained an indictment and unsealed that indictment to let the whole world see exactly what he is alleging. It would be political if he could only find a camera and make these allegations without every having to present a shred of evidence to support his claims, kind of like you do around here.
