I had a wild hair 15 years ago and went through 6 years of law school at night and passed the bar exam. I decided not to practice law because I was making too much money in my current field but things like this always interest me. I read the new code and two things stand out. One, its the education code and only addressing the education system and public schools. Two, the only thing changing is the definition of discrimination in schools. The language is as follows: disability, gender, nationality, race or ethnicity, religion, sexual orientation, I dont see how there is any way with this new code language would eliminate the word mom or dad or allow different gendered people to use the same bathroom. It sounds like one or more of the Governors opponents are using this as a talking point to boost their campaigns. I see this as a bunch of overblown hype.

That's exactly why it is dangerous, the battle over PC language is now being waged with children in the crosshairs, not adults who can make logical decisions. As Deceks pointed out, it's a springboard for lawsuits. The elimination of the words is allowed when it is determined that dad and dad or mom and mom are being discriminated against by absence of mention (the more likely scenario is that textbooks will now begin to mention gay parents in addition to straight ones). Do you really think that California doesn't have a few residents/gay educators willing to take this to court? And just imagine the publicity that the ACLU will get when they represent Henryetta the trani sociology teacher who got his/her feelings hurt by a student who says they believe parents ought to be mom and dad, not lad and lad. Whoever said lawsuits had to have merit?
I think you are being paranoid and the example you cite is not germane. The student can discriminate all he or she wants. The code applies to the actions of schools boards, schools, administrators and teachers. The public is not responsible for enforcing or adhering to these restrictions. Students can freely protest, call teachers dyke's, fags or whatever and they cant incur any penalties under this law.
