It was funny, but it was offensive. I am sure there were a lot of women and children there who did not appreciate the "display." However, it should not be a felony. I really don't understand the point of it, other than just to draw attention to oneself. Streaking is strangely gratuitious. I would have hoped we have become more grown-up than that. Found this. Don't know if it is already posted, I didn't read them all. The text is pretty long, I just tried to pull out what I thought related to this thread and post it. If this is the current law, I guess it boils down to the definition of "patently offensive". I've looked and can't find where it is defined in regard to such a case. I remember seeing that streaker on that day. I for one, believe whatever penalty that they give him, is well deserved. Although streaking is a little funny, but remember, there are kids at the games and it is something that needs to be enforced. They should have stiff penalties for streakers. Even if it is being considered a sex offender. Tell your friend he should have thought about all that before he drank too much and did that. Streakers should be punished to the fullest extent of the law. I personally, applaud stiff penalties for streakers. Do me a favor, tell your friend who streaked that he deserves to be considered a sex offender.
Did you know in Colorado that if you get caught peeing in public, you will get charged as a sexual offender. All they are going to do is lower the significance of the term sex offender by putting these types of crimes under sex offense. Which is dumb, they need to keep the term for the real pervs.
On second thought, this may just be a case of the DA wanting jail time and the offender wanting to get off with some "slap on the wrist" type of fine. Maybe the DA is going after this trying to get the guy to plead down to something still involving doing jail time? These laws are getting tougher when children are involved, and regardless of the intentions of the person committing the act, if children are involved, it is going to be elevated to a much higher level.
I think the punishment is rediculous. I think they could punish him really hard without ruining his wife. If I remember correctly, he did not make any gestures to add to the streaking. I was thinking about how this is bad for the kids and thought - Why is it bad for the kids? I know kids should not see lots of things, and streakers certainly aren't good for them...but, are their eyes more sensitive than adults? Just because kids saw a streaker should not mean that this guy is a sex offender. One of my friends was the guy that streaked at the baseball game earlier this year. He is facing the same thing. Basically, the d.a. is trying to make sure he never has a chance to get another job. The punishment sounds just a little severe to me.
Okay, I admittedly haven't read all of the posts on this thread, but I was at the game, soaked from the rain, irritated with the delay in the game, and four months pregnant (wearing a white t-shirt) to top it off. I thought the streaker was funny (and, frankly, I couldn't see any "thing"). I'm a mother of two young girls, and if they see a streaker, I'll explain that it's silly/stupid and that I wouldn't want them doing it--but I don't find it to be a sex crime. A few months ago, someone sent me a website that lists sex offenders in any neighborhood in the US. I typed in my address and was really upset that there was an offender two blocks away from my house. So, I researched the guy. He's 38 years old, and when he was 18, he had sex with a 16-year-old girl. I'm sure the girl's daddy was mad about it, and now this guy is a lifetime sex offender? We should really save that distinction for rapists and child molesters.
Man, we really are an uptight society these days. Streaking has nothing to do with sex. It's nothing more than a stupid prank and should be nothing more than a misdemeanor. Fine the dude and move on. Our DA should be focused on real sex offenders.
Ok, here is the Louisiana law for obscenity... I seriously doubt his intentions were to arouse 90,000 fans. The "patently offensive" part could be a problem b/c we have such an uptight society. I think it's a stretch to charge him with obscenity. Louisiana Obscenity Law
Now THAT should be legal. On the topic of the thread, the guy should face charges of disorderly conduct. But to call it a sex crime is crazy. Streaking has never been, IMO, and sexual act. Disruptive, yes. Sexual, no. By labeling the person as a sex offender when the system is having problems dealing with and punishing real sex offenders (rapists, pedophiles) is just grandstanding by the DA. (Is it his election year by chance?)
