You're an idiot and a liar. The jury didn't say there was no rape. The jury signed off that the plaintiff didn't PROVE rape with a preponderance of evidence. It's very clear, however, that they believed a rape had occurred. Rape, according to many jurisidictions and almost all medical and psychological professional organizations: Rape RAPE is the penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim. They believed Carroll when she said she had been penetrated, thus the finding for assault, but under NY law (as opposed to Federal law and many other jurisdictions) a prosecutable finding of rape technically requires penetration by the penis. Apparently they felt that she hadn't proven she had been penetrated by that rapist's penis and that the sexual battery charge would suffice to get her relief, anyway.

Rape (a)Rape.—Any person subject to this chapter who commits a sexual act upon another person by— unlawful force against that other person; sexual act (1) Sexual act .— The term “sexual act” means— (A) the penetration, however slight, of the penis into the vulva or anus or mouth; (B) contact between the mouth and the penis, vulva, scrotum, or anus; or (C) the penetration, however slight, of the vulva or penis or anus of another by any part of the body or any object, with an intent to abuse, humiliate, harass, or degrade any person or to arouse or gratify the sexual desire of any person.
