    Although I would say his statement of intention is an automatic fail of the background check.

    Probably not. What a buyer says verbally to the seller wouldn't be part of the information on the paperwork submitted to the feds.

    Correct. The one's who approve would never hear that.

    What's next, the person who sold the car to the woman that ran it into a crowd will be liable too? Or if someone buys a skinning knife and stabs 4 people in a classroom, is the seller liable?
