I guess it's more aptly named the dealer Loophole or whatever. Many dealers take the position that they're hobbyists and don't have to do background checks. Need to tighten up definition of a dealer.
All the big and small gun store and pawn shop owners are required to do background checks. They are already classified as dealers. But there are people who could rightfully be termed hobbyists who rent a table at a gun show and only have 8 to 10 or 12 weapons for sale. They are private individuals just like you and me and there is no need to impose restrictions on their activities that many couldn't afford to comply with.
If you set up a table at a gun show, you are a dealer. If you sell a gun on ebay that you no longer want you aren't. How is a guy selling 12 guns at a gun show not a dealer?
Most don't end up selling all the guns they brought. And eBay does't allow the sale of firearms. Say a guy has 10 guns he doesn't want. He sets up at a gun show and puts them on a table. He would be lucky to sell 2 or 3 unless what he has is in high demand.
If you're selling 10-12 guns at a gun show, you should be doing background checks imo. It's not that tough of a hardshi .

Many small time hobbyist will attend just a few gun shows a year where they meet other gun enthusiasts, make trades and maybe sell a gun or two from their collections. Real gun dealers set up at gun shows almost every weekend and often travel hundreds of miles. They are the ones making a living selling firearms, not the hobbyists.
