tell me about it! well, it wasnt obvious to everyone :redface:. so how is the accused supposed to know this? that really makes no sense to me. it kinda contradicts "the right to remain silent". if the accused thinks they have this right and are invoking it, but really not, seems to me a whole different can of legal worms is gonna be opened.
I have been arrested without breaking a law. It got thrown out and the cop reprimanded, but he still did it. Not the norm perhaps, but it can and does happen.
Most departments (mine included) require the question, but it is more policy than legality. As far as continuing without getting an answer, most just take as the suspect is observing his right to remain silent and proceed with their investigation anyway.
i dont watch fiction although i did see it done on something like 48hrs. one of those shows on tru tv. its the only channel on at the gym and ive learn to like it.
Are you kidding me?? Everyone in jail is innocent and didn't break the law.. Just ask them and they'll tell you so.. :lol:
