Justice Scalia found dead; The balance of the Supreme Court about to shift

    Which conservative was the one who voted the other way rarely? The one that upheld obamacare, or the one who paved the way for gay marriage? Because that wasnt tge same judge. The court leaned right for sure but was about as balanced as a 9 person court can be.

    Have to agree with Mobius. It was balanced. The leftists stayed left and Scalia led the right opinion. Roberts and Kennedy haven't towed the line. In fact Roberts pissed off the cons in the biggest way when he wrote the majority opinion for ACA. HUGE win for Obama. If we end up with a lib appointee and court you may well see another 2nd amendment challenge and a push to overturn the Heller decision. Scalia was a 2nd amendment champion while both Roberts and Kennedy are tepid as a 2-hours-old cup of hot tea on the topic.

    "in August 1960, the Democrat-controlled Senate passed a resolution, S.RES. 334, “Expressing the sense of the Senate that the president should not make recess appointments to the Supreme Court, except to prevent or end a breakdown in the administration of the Court’s business.” Each of President Eisenhower’s SCOTUS appointments had initially been a recess appointment who was later confirmed by the Senate, and the Democrats were apparently concerned that Ike would try to fill any last-minute vacancy that might arise with a recess appointment.

    So you cite 2 instances where common sense prevailed and you say that's balance? I'm sorry but did they only hear 4 cases?

    Because common sense prevailed not because they just wanted to be balanced or fair. Now, I'll concede ACA. But the gay marriage thing. That one was obvious, should have been unanimous.
