Problem is when it is underage kids involved that "day" in court really doesn't work like it was supposed to. They shoot, then aim STS. I can tell you all I have personal experience with the legal system in LA over a completely different type of issue with one of my kids.........ie using someone else's id to try and get into a bar that had raised the legal age by one year (my daughter was legal to drink at 18 then) so age to enter was 19, she was 18. The entire deal exploded so fast I could not believe it.........potential crimes being considered, Felony ID Fraud down to misdemeanor of same charge........(btw this deal is HUGE now with Feds). I THOUGHT, I could talk to the Asst Attorney for LA and had OBVIOUSLY graduated last in his law school class...............I was way wrong, it guys like this that keep attorneys in business. Long story short, punishment DID NOT fit the crime, they wanted TO REVOKE her license for a year........I say no way........(ever filled out a job app or security clearance that says HAS YOUR LICENSE EVER BEEN SUSPENDED OR REVOKED?) It is a yes or no question, not an explanantion. I sued, won, and they threw it out of court partly because state was very unprepared to try the case (did not make sure his witnesses got their subpoenas!) Many other details but my message to guys I fly w that have teenagers is about the fake ID's and where that can and will lead in today's legal environment..............things have gotten far worse not better. Yes I understand that, in legal terms. But in real life, she either consented or she didn't. If she did, I see it as more of a gray area. If I was her father, that would make a difference. Because my 15 year old daughter can make mistakes too, she can be just as much to fault as the 18 year old. Personally I have had some very uncomfortable talks with my daughter. So that she would not get tricked into anything, yes I told her about "just the tip", and I made sure she knows oral is sex, regardless of what ole Bill Clinton says.
A minor is exactly that...a minor. They legally can not make "adult" decisions like entering a contract, getting married, etc without parental consent unless they are legally emancipated, which has some narrow applications of law to that designation. Even though they may willingly perform an act of a sexual nature, the legal definition of "consent" precludes them "consenting".
Hmm, thanks for that info, I don't remember fake ids being such a big deal. But times change I guess.
This is how Louisiana defines "Oral Sexual Battery": Now the details are still unknown and him being expelled certainly looks bad, but since we're talking about a private school it's hardly damning. I'm going to wait until the full story comes out because I have known plenty of guys who have gotten the short end of the stick simply because we normally give females the benefit of a doubt.
That's fine and dandy. However, we aren't talking about whether the girl's parents think she was or was not partly responsible. The law is very cut and dried. She can not consent. I have a 15 year old. We have had many of the same talks you speak of. She wears a purity ring. Her innocence still amazes me. I can only imagine the fear and humiliation she would feel in a similar situation. On a related note, I could almost swear I read something yesterday that said the entire thing was caught on video. I followed a link from an article to another site that had the info. Has anyone else read this? I have looked and looked today and cannot find it. I was on my phone using a forum app, so there isn't a history I can follow to find it.
Hell I got picked up by Lafayettes finest trying to get into "The Keg" when I was 17. They called my dad to come and pick my up and let me go. I figured pops would be cool with it and mom would be pissed. Boy was I wrong.
