The cost to try someone is significantly less than the cost to detain someone indefinitely with no clear path to ever get to any sort of trial. Gitmo detainees aren't being held for trial, and 12 years removed they have very little useful information. They are being held because we don't know what else to do with them. We have no legal avenue to prosecute them, and no one is going to risk everything writing a brief saying that we do. Many of the 200 or so detainees have been cleared for release by the joint military intelligence task force since as early as 2004, but no one wants to pull the trigger. Gitmo represents a massive miscarriage of justice for the US. And the mess was created by a lazy Bush Justice Department, and is being made worse by an Obama Justice department that won't take a stand either way.

Supa you make some pretty good points. Politicians always want to go with whatever makes them look better politically. They all have trouble doing what's right if they think it can hurt their reelection chances in the future. I think there are pros and cons to both sides of the detainee issues. If I was a soldier, I'd probably be more of a kill them where they stand person. Takes the guess work out of it.
cant do that at Gitmo, you can only sustain a conspiracy charge in civilian criminal court, there is not statue for it in a military court. I agree he should be tried, but its trivial to say civilian criminal court is the wrong place.

Hate to break it to you, but if you were to do this you would have your own tidy little cell in Leavenworth. The ROE is a mess and if you put lead in one of these beady eyed little bastards you had better be able to justify it with witnesses otherwise it would get really ugly for you really quick.
