It's not based on what the robber knows, instead it is viewed in light of the subjective mindset of the victims. If they truly felt that it was a real weapon and reacted as such (a la opening their wallets) then it is armed robbery. As stated above, a finger in your jacket in a bank could be considered armed robbery, especially considering the location.
From what I have heard, in Tennessee the punishment is the same for both. Must remeber, the only reason it was "attempted" here is because the victims had no money on them. Someone is going to plea there charge down here if not all 3/4 of them so I don't think they will serve the sentence for the orignal charge but I don't think they are going to get off scott free either. We'll have to wait and see if they actually do any time behind bars besides what they have done right after being arrested.
All three are probably gonna be better off in jail...unlike the Tennessee locker room these days, there's no toilet plungers there !!!!! :hihi: :thumb: :lol: opcorn: !!!!!
