Only if indicted, tried and convicted. That is how a stable society works. Mob rule is no rule. I have my opinion about what happened January 6 but without following legality there is no justice. I also think HRC was criminally involved in a number of things but again it would take her indictment, trial and conviction before she should be sent to jail.
