In trump's case, whatever emergency powers he thinks he's entitled to have. In the past, US presidents have used emergency powers to use our military against civilians, to wage war without Congressional consent, even to suspend habeas corpus.
No but the president declaring a national emergency and martial law is. Of course the democrats would have fought it but as Andrew Jackson said when the SCOTUS told him he had to do something “Let them enforce it” or words to that effect. Basically Trump had the power of the executive branch to enforce his words. How far he would have been followed and how it would work is unknown and unknowable except it would have been a fatal blow to our system of government.
