I don't buy this. Any time one person beats the shit out of another they obviously don't like them so charge them with battery, etc. Trying to label it further only muddies the water imo. I understand why they do this with homicides and even though I agree with it there, it still sometimes causes issues with prosecution/ convictions. Am I alone in this line of thinking?

Nope, 100% agree. The act is made no more or less dispicable by how the perps "felt" about the victim. I've believed this about the term "hate crime" from day one.
The saddest part is, while this was an intentional "hate" crime, the liberal news outlets are painting this disabled kid as an 18 yr old "adult" and the perpetrators of this disgusting crime as "misunderstood youths" who made a mistake. Bond apparently has been set at $1500/each.
