The courts have held that the 4th amendment is essentially a privacy matter. Only totalitarian regimes show a disregard for individual privacy. Of course the primary issue here is privacy from government intrusion.
First of all I did not say we have no right to privacy. I said anonymity. Were not talking about release of personal banking documents or medical records. This is about people wanting to be able to do whatever they want on the Internet and remain anonymous. That is not a right. All Google is doing is tracking activity that is occurring in a public realm. If this was illegal, tabloid journalism would not exist.
Well I don't think that what you have bolded here makes your case and I will comment on each. This is about the government requiring you to house troops in your home. It has nothing to go with the issue. While I do agree that the fourth amendment guarantees a certain amount of a right to privacy, it applies to the government seizing information or property that belong to you. We are talking about a company keeping records of public activity. Google's server logs are their property not yours. Google has no obligation to keep your activity anonymous. Again, has to do with protecting the citizenry from any expansion of governmental power. In this case we are talking about limiting a private company from gathering public data. How does that apply?
