I agree but that's the million dollar dilemma. The prosecution will argue that by not "stopping" his "pursuit" when the 911 person told him to, that he was the aggressor. I have to admit it's not so cut & dry but bottom line is that Zimmerman was not illegally there. I had someone tell me once that your right to throw a punch ends where my nose begins so if Zimmerman didn't put a hand on him first he'll be in good shape. Since there's apparently no one to say he did, I like his chances to this point. I'm intruged by what the prosecution is setting up. I don't understand their strategy to this disconnected testimony that's actually helping the defense a lot, if not more. I'm certainly not impressed with them so far. I've seen MUCH better from some small town attorneys. Maybe here it's cause there wasn't a case to begin with.
Zimmerman was the head of the neighborhood watch, whose neighborhood just underwent a string of break-ins, he was well within his right to follow anyone he thought suspicious, especially at night with Trayvon walking in the rain. But following someone does not make an aggressor... the prosecution with their "star" witnesses has basically made the defenses arguement for them. This trial so far has turned in to a 3 ring circus.
Now their talking about maybe talking to the jury to amend charges to a possible manslaughter charge... seems like their just throwing shit at the wall hoping something sticks.
Manslaughter wouldn't bother me because Zimmerman is a dumb ass and should have just stayed put like authorities told him to do. Had he done that he wouldn't have had to shoot the dude. But what I would sentence is manslaughter and then give him time served, throw another 5 year probation on him and make it to where Zimmerman cannot own a firearm, nor be part of any neighborhood watch program. Someone breaks in, do it the old fashioned way, with a Easton Black Magic baseball bat.
