"Shurtleff contends the BCS is an illegal monopoly that violates antitrust regulations since it deprives schools in conferences without an automatic BCS bids, such as the University of Hawaii, equal access." i think mlb is illegal because it doesnt allow my local softball team equal access. i think the guys at my local park are illegal because they want to play with each other and not me.
there have been anti-trust lawsuits against MLB, at least three of them went to the US Supreme Court also, try not to focus on what some USAToday staff reporter wrote. the anti-trust laws don't just make monopolies illegal, they also make it illegal to restrict free trade by engaging in other anti-competitive practices as well. so just because you don't have a "monopoly" doesn't mean you aren't breaking the anti-trust laws but as the Penn State President/head of the BCS presidential oversight committee said:
the Utah State Attorney General spearheading the criminal suit against the BCS, Mark Shurtleff, doesn't seem like someone you want to mess with: he's a Republican, an Eagle Scout, spent 4 years as a military officer/prosecutor in the United States Navy Judge Advocate General Corps (JAG), 2 years as an assistant district attorney in Salt Lake City, 5 years as an assistant attorney general in Utah, 11 years as the Utah Attorney General (the first 3-term attorney general in Utah history, winning his last two elections by 70% of the vote), Past Chairman of the CWAG (an association made up of the Attorney General of 30 different states), and has served several times on the Executive Committee for the National Association of Attorneys General (NAAG). he also has further political aspirations (he entered the 2010 race for the US Senate, but withdrew because of health concerns with one of his children) most interesting regarding his connection to college football: he's a devout Mormon (did his Mormon mission in Peru) and he's a graduate of BYU (who recently left the Mountain West conference and became an Independent)
