I believe it. I hit a dog on HWY 90 about 8 yrs ago doing about 65mph. It wiped out the the entire front end of my truck. And that was a Lab I hit with a 88' Toyota pickup, back when trucks still had chrome front bumpers. I don't get what a "crane operator" is doing in harm's way? (unless Stillhurt was where he shouldn't have been)
The articles I've seen don't have the detail to say it's manslaughter. Is that speculation? If so, that's pretty irresponsible.
True. I should have said vehicular homicide. Manslaughter only if it's due to gross negligence, which we don't know that as of yet. Thanks for pointing that out. Maybe a mod can change the thread title.
But there might not be a crime at all...that's all I'm saying. People get hit by cars sometimes, and there's no criminality.
Once again you are correct. I thought you either get charged with one or the other, with Manslaughter almost always being a felony and homicide considered a misdemeanor. But in the case of no fault to the driver (i.e., the person just ran out into the street without notice) you would be charged with either. Carry on.
I'm not a lawyer but if he was DWI it won't matter a lot if the person walked right out in front of him. He will still be blamed.
