If you are falling down drunk and its captured on the police video obviously you are going to be convicted. If you are able to be coherent and rational and don't give evidence against yourself by blowing into the ballon your odds of beating the rap are greatly enhanced. My advice is to pay whatever it takes to avoid a felony conviction. You will lose your right to vote and your right to bear arms.
Im just telling you that that is what they teach in ABC and TABC classes, and in order to get a liquor card to be able to serve liquor. No one ever goes by it though because if they did, no one would ever sell any liquor or beer. To me it really all depends on your liver. If you are a seasoned veteran then your liver breaks alcohol down faster. And the state must not care about too much either because restaurants in Baton Rouge i know for sure serve 2 for 1 at alot of places.
It is this defense that has started the mobil DWI RV's that carry a nurse and a "judge" to get the paperwork started at the scene. FWIW. On another note, I would rather take my chances on a road chocked full of "happy" Tiger fans after a game than a lone car driving down the road full of 16 year old girls updating Facebook on their IPhone, at night and 60 plus mph.:geaux:
In my career, twice a year I must acknowedge to the FAA via my physical if I have had ANY license actions taken be it a mis/felony they don't care. My advice to my kids a few years back emphasized the fact that almost all job apps these days let alone security clearance's use the terms "have YOU EVER HAD/BEEN...........". The days of a true recovery from certain mistakes are long gone depending on what kind of career you want/have. Suggested decision matrix for those with teens/kids at home. Before they do ANYTHING, ask 2 simple questions. 1. Is what I am about to do legal...............Yes.....go to step 2. NO ..............seek more ADULT guidance before continuing any further. 2. Would my mom/dad/guardian approve of what I am about to do. Yes...................do it. NO or any other combos that are not YES/YES, seek guidance as in step one. FWIW............just technique, your mileage may vary.:geaux:
I remember back when I started college. Down here on the bayou the police force was a joke and the traffic didn't exist at 2 am cept for some trucks heading to fourchon. these days, you can't drive 10 mins in any direction without seeing a cop. So I obviously don't drink and drive anymore, one to may close calls and it's just not a risk worth taking. Plus I have the added benifit of having a fiance that doesn't drink, so DD FTW. That being said I know a bunch of people that have 1 2 3 or even 4 DWi's or Dui's. I know 1 guy who got 2 in the same week. Pretty standard situation his wife left him, he decided to drink his sorrows away.. etc..etc It's really a stupid move, don't do it.. stay home or get a DD imo That being said, according to something I read, the body can absorb 1 drink per hour.. so a glass of wine at dinner is not going to put someone over the limit. I also read that they did a test and texting is worse then drinking and driving... How many of you text while driving?
Texting means taking your attention off the road but being intoxicated means your response time is seriously delayed, and you have lowered inhibitions (for the younger guys that means driving faster than usual, or otherwise taking chances you normally wouldn't). I don't know if I'ld say one was worse than the other, depends on the situation. One can be an "experienced" drunk and not appear intoxicated but can never recover the lost response time.
(this post in no way condones drunk driving) way back in my college days or before. if i ever was to get behind the wheel after having a few, i would be sure to 1) go the speed limit 2) make sure i'm not swerving. the fear of being pulled over is powerful thing for normal people. however, people who drive like idiots (the loss of inhibition as you mentioned) knowing they have alcohol in their system is just beyond stupid.
