I wouldn't object if a jury found Clemens guilty and sentenced him to some time behind bars. Is the legal issue in question where he is suing McNamee? If it is, he might want to think about dropping the suit if that's legally possible. You have another leg up on me as I haven't stayed at a Holiday Inn in years.
agree. everyone knows he was juicing, but it's gonna be hard to prove he "knew" what was in them syringes. He cam always fall back on "I thought it was B12 and lidocaine"
The other question is how can it be proved that these syringes weren't fabricated. It would be quite easy to inject with one substance to have the DNA evidence, then fill them with something else, get the juice in there and dump it out. It's going to be tough to prove a number of things, so I don't think this is going to end up going anywhere.
There is no chain of custody on the syringes, thus no proof they were used on Clemens. Unless Clemens' DNA is the syringe, it could have been used on anybody. The syringes do corroborate his testimony that he injected Clemens with steriods which may add to his credibility as a witness.
thats the implication. this is big if it has both substances that clemens told congress he didnt use and clemens' dna.
I agree with stadiumsalute and hatcher, if OJ's lawyer could attack the DNA evidence where blood samples were in police custody the whole time, and for a much shorter period of time, and these syringes with in McNamee's "basement' for 8 YEARS, no way Clemens goes to jail. There is too much opportunity to tamper for it to be "beyond a reasonable doubt". Roger stays a free man, though reputation is tarnished.
