Chad Johnson sentenced to 30 days for butt-slap.....

    You're correct, that's what happened. And yes, stupid clowning move by 85 and big-time overreaction by the judge, who I suspect wanted any excuse to not accept a plea bargain from a dude who head-butted a woman.

    That does seem a bit extreme to me. Was it silly for Ocho to do this? Absolutely. Did the judge overstep? As a technical matter, probably not (in Louisiana contempt of court can get you 6 months in the parish jail) but as a practical matter it looks a bit over the top. Pretty classic case of black robe fever.

    The question then would be (and wjray, I know you're more qualified to answer the question than I) was this really contempt of court? My best guess would be that c.o.c. is defined by the person on the bench, but I have to give some credence to what Bayliss said this morning. Immediately before the butt-slap, the judge complimented the attorney on his performance and even asked 85 if he was happy with the attorney's work. That exchange doesn't seem typical to me, and almost could be interpreted as the judge lowering the bar from formal court proceedings to an informal exchange of pleasantries. Chad was still foolish and just dead-wrong for doing what he did, but he could argue (in the court of public opinion) that the judge set the tone, sort of a "officially we're done, now let's relax and chat for a minute before we go."

    I've been in court. "Yes sir. No sir." Butt slap never crossed my mind.

    Yeah, i don't think anyone disagrees that ochocinco is an idiot. It's just that the judges response was pretty ridiculous.

    I can't help but believe that if the judge had a penis this would have never happened. Call me a sexist all you want but a male judge would have joined in the laughter and dismissed the court room. I hope Red is right and she gets a lot of blowback from this......what he did wasn't right but it doesn't warrant 30 days in jail.

    Agree. As I said before, this was a female judge in a domestic abuse case. There's a very good chance she wasn't happy with a plea bargain situation that was going to allow the defendant to walk without jail time. Then CJ gave her an excuse to change the game.

    I have no idea what the law is in Florida, but in Louisiana direct contempt of court is essentially any behavior that is insolent or disorderly and tends to interrupt or interfere with the business of the court or impair its dignity or respect for its authority. So, yes, contempt is in the eye of the robe wearer.

    I watched the tape once and as I recall the judge did tell Cinco he should thank his attorney. The judge I practice in front of most for criminal matters frequently tells defendants they should thank me (or other attorneys) or send Christmas cards when the defendant gets a sweet deal. I once even had a female client, upon being told this, hug me and kiss me on the cheek, which was not an entirely pleasant experience (you'd understand if you ever saw her picture). That produced some laughter in the courtroom, which was quickly quieted when a bailiff firmly said "Order in the court."
