you still don't get it. By your reasoning it doesn't matter if it is ABBA or the hottest band in the land nor should it matter. The point is, if you pay for a subscription to a service like Pandora or if you are using a FREE medium like FM Radio you don't owe anyone any royalties. Its just that simple. If you are streaming some pirate feed, or if you are using your internet connection to play stuff directly from a bands website or something like that then yes, but using FREE radio, something any other person can get by going to their car or their phone for that matter, OR a PAID subscription site that they can also get from their car or phone or PC does NOT require ANY additional payment. End of fucking story.
Yes I get that. But playing a radio is NOT commercial use even if you play it at a business. It's the radio, it's available to everyone and it's free.
Yes, we established that several pages ago. Downloaded playlists, CD's, and other copyrighted material that DJ's use do owe royalties to ASCAP if used publicly. I'm sorry that you dislike this, but it is a fact.
Grateful Dead would allow people to record their concerts. I used to know a guy who had every concert they had ever done. He had boxes and boxes full of GD concert cassette tapes.

Says the DJ. Garage bands don't care, new acts don't care, they need the exposure. But major acts with agents and music publishers and accountants definitely care. They get checks ever month from ASCAP that they count on.
Paul McCartney is counting on his ASCAP check to buy jet fuel for his G650. It would be a real shame if he had to stay home because his check was late.
