It's a strange situation, I'm not familiar with all the rules when it comes to ASCAP but it will be interesting to see in Neil sues Trump, because that fucking douchebag (trump) sued Bill Maher because Bill called him the spawn of an orangutan and Trumps mom, not to mention the countless other ridiculous lawsuits he's filed over the years.
If Trump sings the song, hires a brass band to play it, or another singer to perform it, it is fair use, and ASCAP will only make sure that royalties are paid if it is used commercially. But if he uses the James Taylor recording, then he must get permission from Taylors publishing company. He would also be subject to a lawsuit if he hired a musician to exactly replicate James Taylors voice and arrangement in an attempt to get around the law.

No, a guy worth 9 billion dollars is going to pony up the royalties, which ain't all that much. But a lawsuit for using a recording without permission could cost him a lot more. He will find another song.
