There is no discrimination. You can have the breaks as soon as you get yourslf some kids. And then its retroactive to the begining of the year. If you are smart you can adopt a baby on 12/31/11 then return it on 1/1/12. Unless you are a functionally impotent that has been ruled mentally unfit for adoption you are good to go.
