    vehicular homicide is still an accident. prison time? you bet. and a helluva long time! especially since drunk and driving under suspension. a looooong time in prison will hopefully ensure this scum doesnt ruin more lives.

    but it isnt first degree murder which is premeditated which does and should carry the death penalty.

    He certainly won't get the death penalty but murder charges were filed which is unusual for DUI cases. The problem for Gallo is what he wrote back in 2006.

    Clearly there is a hint of intent since he did not take steps to avoid the accident.

    you damn right the death penalty.

    If that was my son that got killed like that, i would enforce my own death penalty.
