Then why was the ACA, the biggest power grab maybe ever passed with a 51 vote simple majority through the reconciliation process in spite of the Senate shift with a Republican winning Ted Kennedy's seat? The American Representative Republic system was designed to provide opposition when things do not make sense. The 2010 elections were a push back against the Democrats deciding to ignore the will of the people.
