The five released prisoners are unrepentant, militant and dangerous. But that's what you must do to to regain hostages. We say "America doesn't negotiate with terrorists", but it is nonsense. Of course we do (see Reagan, 1985). Everybody does. The Israelis, the toughest of all anti-terror fighters, gave up 1,027 prisoners in 2011 for one staff sergeant. So what? McChrystal supports the decision to get the soldier back. That is the point. Two imperatives are at play here: Bergdahl remains a member of the US military and therefore is (a) subject to military justice and (b) subject to the soldiers creed that we don't leave anyone behind. Of all of the jurisdictional disputes between Presidents and Congress, the president stands on his firmest ground as Commander in Chief. And he has the power to negotiate prisoner exchanges. Congress was aware that negotiations were going on, they have stated this. But the 'notification" had to be foregone, the White House has reported, because the Taliban threatened to kill Bergdahl if word of the negotiations were made public. It forced quick action. In any case the "notification" would not have enabled Congress to interfere with the Commander in Chiefs authority to negotiate prisoner exchanges.
