Props must be given to all Texans for overwhelming shooting down Proposition 2 yesterday, thereby banning gay marriage (again). Unfortunately, in their rush to the polls, no one looked very hard at the wording of the proposition. SECTION 1. Article I, Texas Constitution, is amended by adding Section 32 to read as follows: Sec. 32. (a) Marriage in this state shall consist only of the union of one man and one woman. (b) This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage. So not only is gay marriage not allowed, because of the sloppiness of the drafting of the document, so are civil unions, and if you read between the lines, all marriage. Divorce attorney's are going to have more business then they know what to do with as the Texas Legislature and the voters just cancelled every marriage certificate in the state in one fell swoop. :thumb:
Actually, concern in the Texas legal community is that attorneys with a stake in spousal liability (personal injury, workmen's comp, etc.) could argue that the Texas Constitution does not allow for spousal liability because there can be no spouse. Nobody honestly thinks a court would construe the amendment as such, but it does make for a funny discussion. You would think they'd mix in a proofread before submitting, discussing, voting, and passing some amendment!!
WHEW! Man, good for Texas. I was afraid that things were really going to get out of hand there for a while. Now that gay marriage is illegal, the crime rate is certain to drop drastically, the quality of education is certain to skyrocket, and every family household can live peacefully, without the constant agony of kowing that those evil fags are married.:thumb:
Maybe, except for one thing. It probably costs more to have a roof put on in Mexico because most of the roofers crossed the river and are working in my neighborhood.:grin:
