Justice Scalia recused himself from the pledge of allegiance case before the Supreme Legislature. That leaves open the possibility of the Kings and Queens humming to the tune of 4-4 on their moral proclamation. I applaud Justice Scalia on his decision since he made obvious his opinion before the case was heard by the Supreme Legislature on this moral issue. But, I must question why Justice Souter didn't exhibit the same discipline and recuse himself from the buggery case?
