Is there a lawyer in the house???

    My cousin and I got victimized with some fake tickets. We found the guy and had him arrested, but we did not get our money back. Does anyone have any legal advice. The guy had about 1000 dollars cash in his pockets. Will this money be confiscated for evidence? Any chance I will get any kind of restitution through criminal court?

    you might get your money

    Usually restitution is part of the requirements of the sentence, assuming he GETS sentenced. In other words, you have to be certain that the case is prosecuted, and doesn't just languish or somehow get dismissed. This is a felony because of the amount of money involved but the prosecutors' office in N.O. is probably overworked, so be sure to get in touch with whoever is the Assistant D.A. who is handling the matter and offer your help and tell him/her you need your money. You will probably need to help with getting witnesses, giving descriptions, information, etc. If the person doesn't disappear and does get prosecuted, you should get your money back eventually.

    File a complaint or Statement.

    To add to what NJTiger said, make sure to file a complaint/claim/victim’s report giving as much details as you can regarding the crime, specifically detailing the property and its value that was stolen from you. In Florida, the state attorney's office corresponds with the victims throughout the case and restitution is almost always a part of sentencing whether pleaded or tried. Also, make sure that you are aware of any co-defendants as they will most likely be jointly and severally liable for your stolen property. Good luck to you; I hope that you get the full amount restored to you.
