I'm suing Onepeat.com for Battery! Funny stuff from a USC Forum...

    Even before the billboard is up, they are wailing and gnashing their teeth. This is one of the funniest threads I've seen in a while...

    USC Legal Minds: Causes of Action re Onepeat.com

    I'm not a plaintiff's lawyer, but based on the already existing billboard on the website www.onepeat.com, damage has already been done even without the sign going on a billboard. Just thinking out loud:

    POSSIBLE DEFENDANTS TO NAME:

    1. Rich Sullivan
    2. Sullivan St. Clair
    3. onepeat.com
    4. The billboard company that allows the sign to go up
    5. GMAC Bowl
    6. Individuals who donated money to support the cause
    7. UCLA, LSU, UT (I'd also name them as their mention on the website and in the sign reasonably implies endorsement, affiliation; UCLA, LSU and UT would then cross-claim against Sullivan and onepeat.com for indemnification)


    POSSIBLE CAUSES OF ACTION:

    1. Trademark Infringement
    2. Dilution
    3. Copyright (this could take it to federal court)
    4. Libel
    5. Trade Libel
    6. False Light Invasion of Privacy
    7. Common Law Misappropriation
    8. Commercial Misappropriation
    9. Intentional Interference With Prospective Economic Advantage
    10. Negligent Interference With Prospective Economic Advantage
    11. Unfair Competition
    12. Negligence
    13. Intentional Infliction of Emotional Distress
    14. Negligent Infliction of Emotional Distress
    15. False Advertising


    POSSIBLE DAMAGES TO SEEK:

    1. Loss of business, current and future
    2. Punitives
    3. Loss of consortium
    4. Disgorgement of Profit (T-shirts, etc.)
    5. Attorneys fees and costs
    6. Permanent Injunction

    They are going to try & scare them out of putting up the billboard. It might work.

    Hope they have a lot of money, especially if they are including donors on that list of defendants. Won't exactly be cheap to go up against a Richard Manship.

    They won't have to. I seriously doubt that want to really follow this. The person that started the site & wants to put up the billboard cannot afford (I'm guessing) the court costs, and they will try to bully him into changing his plans & not putting the sign up.

    The argument is weak on most of their charges, but that may not matter either.

    Won't work. Their claims are baseless and over-exaggerated.

    They don't have a single actual complaint that can be enforced if the sign goes up soon
