Filing Fees The severely limited power-relationship between Government and the Individual needs to be firmly asserted in America. Filing fees are, in my opinion, an unlawful obstacle to the individual's rightful access to court. Apart from the patent unlawfulness of a filing fee requirement, the in forma pauperis requirement violates the equal protection of the laws clause found in the Fourteenth Amendment. Since elections will never bring America to its politically lawful state, the People must either repair it via court, or by rebellion. Court makes more sense than risking violence and bloodshed, but it requires a foundation of knowledge and respect for lawful access. It also requires the resolve to prevail. I believe that cooperation between a network of Justice Fellowships - with one in every jurisdiction in the U.S. - could accomplish that noble goal. tgsam
All three branches of government are more than adequately tax-funded. Although time has given it the appearance of legitimacy, there is no need for filing fees. I seriously question the lawfulness of the requirement. An illegitimate legal system has supplanted the genuine law of the land. It is in the best interest of the American People to acquire the knowledge and the will necessary to destroy an increasingly evil system. tgsam
Don't worry about it tinsley. If you use the same vernacular when you speak in public as you post here you are never going to get elected to dogcatcher. Go spend your filing fee money on some more hippie lettuce
I think he's suggesting an uprising. And I'm not even trying to be funny here. A ton of his posts seem to point toward wanting a revolution. This has gotten out of hand. The court fees are just that. Court fees. The courts employees need to get paid and that's where most of this comes to play. Are you a lawyer, tinsely? If so, what type? Family? Malpractice? Criminal? Also, I feel like the basis of some of the court costs is to keep the frivolous suits and what-nots at bay.
I suspect tinsley wants, or wanted to, be a lawyer but could not for whatever reason. There is enough frivolous litigation in this country already. If you remove having to pony up court costs, it'll only get worse. That alone is a valid reason for charging for access. Edit: I just saw BB's last line. Great minds...
also tinsley doesnt seem to understand what makes something legal or not legal or why that matters. reminds me of the anti-war protesters: "stop this illegal war now". you cant just go around claiming things are illegal and make a difference. nobody cares what is legal according to you or some document you found, and that isnt a real reason to do or stop doing something.
