Don't want any religious arguments here.. just a simple question... Question to anyone who knows the law... A person who murders a pregnant woman can be charge with 2 counts of murder yet Abortions are legal. Seems an obvious contradiction. What is the legal justification for this? Anyone know if its been addressed? Seems like a person brought up on double-murder charges would challenge one of the charges based on this argument. Again, keep religion out of it... I don't care what your beliefs are... I want to know about the law behind it...
I am not sure but maybe it has something to do with the age of the fetus. Being that abortions are only legal within a certain amount of time, maybe a second charge can only be brought up if it after that time. Mind you this is only guessing I have no legal background or info to say this is true. Or it maybe that once you have actually killed another human they just decide to throw the book at you and get more charges. Can't say I would really mind that also. I am sure somebody else can help you further.

Not to hi-jack, SabanFan and Faulkinberry user names on an LSU and UL forum, respectively, is kinda like a double murder, ain't it?
I don't think there's been a double-murder mother-fetus case big enough to challenge it. Even the law admits that it is a contradiction & will eventually be addressed, but they haven't been pressed to yet. The difference is whether the mother wants the fetus or not, but that doesn't change the fact that there isn't a unanimous definition of life through-out the law.
Wasn't that guy out in cali charged for his wife and unborn baby? I am not sure by any means and cant remember his name but I thought he was. There was a lot of media hype with it...he was talking to his new girlfriend at the time and she turned him in. Crap...cant remember the specifics!
